7 . RIGHT OF WITHDRAWAL AND RETURN POLICY

7 .1. Right and term to withdraw.- If you are contracting as a consumer, you have the right to withdraw from this contract within a period of 14 calendar days without the need for justification.

You can exercise your right of withdrawal when 14 calendar days have passed from receipt of the product. Or when 14 calendar days have passed from the date of conclusion of the contract in the case of services purchased online.

7 .2. How to exercise this right.- You can exercise the right of withdrawal in the way that is easiest for you through an unequivocal declaration (for example, using the form attached in the Annex in these Conditions or by sending an email) by notifying us of your decision to withdraw from the purchase to the address orders@ami-iyok.com

To meet the withdrawal period, it is sufficient that the communication regarding the exercise by you of this right is sent before the end of the period indicated in point 7 .1 . Ami Iyök will notify you without delay of receipt of your withdrawal notice.

7 .3. Consequences of withdrawal.- In the event of withdrawal, we will refund all payments paid by you, including shipping costs, but additional costs resulting from your choice of any delivery method will be excluded (see point 7.6) , without no undue delay and, in any case, before 14 calendar days have elapsed from the date on which we are informed of your decision to withdraw from this contract. 

We will proceed to make said reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise and as long as this does not imply any expense as a result of the reimbursement. However, the foregoing, we may withhold the refund until we have received the goods.

7 .6. Costs.- You must bear the direct cost of returning the goods for which you have exercised the right of withdrawal.

7 .7. Decrease in value.- You will be responsible for the decrease in value of the goods resulting from a manipulation other than that necessary to establish the nature, characteristics and operation of the goods. That is why the goods must not be opened or tampered with.

7 .8. Such reimbursement Please note that Ami Iyok may withhold reimbursement until it has received the goods back or you have supplied evidence of the return of property, as the condition is met first. 

Your right of withdrawal may be affected in the event that it has been exercised outside the established period, if one or more products that are the object of the order with respect to which the right has been exercised, respectively, have not been returned, among other cases that may arise. .

Therefore, Ami Iyök will inform you if you have the right to reimbursement of the amounts paid in the corresponding cases and after the appropriate checks in accordance with the provisions of the Consolidated Text of the General Law for the Defense of Consumers and Users.

7 .9. Exceptions to the right of withdrawal.- You will not have the right to withdraw from the contract whose object is the supply of any of the following products:

  • Personalized items;
  • Goods sealed for health or hygiene reasons that have been unsealed after delivery.

7 .10. Return regime applicable to the Canary Islands and other territories.- If you wish to exchange or return a product that had been delivered in the Canary Islands, you can do so by contacting us via email orders@ami-iyok.com to provide you with the corresponding information regarding the return or exchange . 

If you have placed an order through this website from a Member State of the European Union other than Spain, the conditions to exercise the right of withdrawal will be of the same application. Likewise, we inform you that we will not be obliged to reimburse you for shipping costs other than those incurred to the original delivery address in Spain or return costs from a destination outside of Spanish territory.

 

8 . TECHNICAL MEANS TO CORRECT ERRORS

8 .1. In the event that you detect that an error has occurred when entering your personal data during your registration as a user of this website, you can modify them in the “My Account” section.

9 . PRODUCT AVAILABILITY

9 .1. All orders are subject to the availability of the products. Ami Iyök will make every effort to supply the products purchased in accordance with your order summary, however there may be times when Ami Iyök cannot supply such products. This may be because, for example, these products were not in stock or because an error had been identified in the price or in the description of the product, etc. In these cases, Ami Iyök will contact you to inform you and, where appropriate, propose alternative products that meet your needs. If you are not interested in said product alternatives, Ami Iyök will proceed to cancel your order in relation to the products that cannot be supplied, obtaining a refund of the amount paid for this concept.

In these cases, Ami Iyök will only be responsible for the refund of the amount paid by you, without the latter having the right to claim additional amounts.

9 .2. It could also be that Ami Iyök could not accept your request. In this case, they will contact you as soon as possible, through any of the means that you have provided at the time of ordering and for the purpose of proposing alternatives.

1 0 . DELIVERY

1 0 .1 Before placing the order, you must select the delivery method that best suits your needs. We will send your order consisting of the products listed in each Shipment Confirmation without any undue delay and at the latest within 72 hours from the date of the Order Confirmation, except as provided in clause 24 of these Conditions.

Please note that there are circumstances arising from the customization of the products, or unforeseen or extraordinary circumstances that may affect the delivery date.

1 0 .2. If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option to proceed with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. Bear in mind, in any case, that we do not deliver home on Saturdays or Sundays.

For the purposes of these Conditions, it will be understood that the “delivery” has occurred or that the order has been “delivered” at the moment in which you or a third party indicated by you acquire material possession of the products, which is will accredit by signing the receipt of the order at the delivery address that you have provided

1 1 . IMPOSSIBILITY OF DELIVERY

1 1 .1. You agree that you or another designated person will be at the indicated address to receive the order from Ami iyök . If you are not there, the carrier will try a new delivery or, if possible, will contact you.

1 1 .2. In the event that delivery has not been possible, your order will be returned to our warehouse with the subsequent return of the payment made less the shipping or return costs, which may occur, which will be at your expense.

1 2 . ITEMS PRE-SALE

1 2 .1. In the case of making a purchase of pre-sale items, they will be delivered to the address selected by you within the terms indicated on our website.

Keep in mind that some of these items are subject to longer delivery times, which will be those shown on the website and, in any case, will be delivered within a maximum period of 30 days from the date of the Order Confirmation. .

1 3 . TRANSFER OF RISK AND OWNERSHIP

The risks of the products will be your responsibility from the moment of delivery.

You will acquire ownership of the products when we receive full payment of all amounts due in connection with them, including shipping costs, or at the time of delivery (as defined in clause 7 above), if this took place at a later time.

1 4 . PRICE AND PAYMENT

1 4 .1. The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount.

Product prices may be subject to change, but possible changes will not affect orders for which we have already sent you an Order Confirmation.

By clicking the “Pay” button you are confirming that the credit card is yours or that you are authorized to use it. However, if the security department suspects an anomaly or fraud, Ami iyök reserves the right to cancel the transaction for security reasons.

Online payment by credit / debit card is made through the Redsys security system that encrypts your bank details when they are transmitted over the internet. Credit cards will be subject to checks and authorizations by their issuing entity, but if said entity does not authorize payment, we will not be responsible for any delay or non-delivery and we will not be able to formalize any contract with you.

For security policy reasons, Ami Iyök verifies all orders paid by bank card.

In general, Ami Iyök also accepts cards that use the Verified by Visa secure payment system or the 3-D Secure system .   

1 5 . PROMOTIONS AND COUPONS

All promotions and coupons have a specific expiration, as indicated in the promotion itself.
Promotions consisting of discount coupons will always be applied solely and exclusively to the value of the product.

Ami Iyök reserves the right to cancel its promotions to users who make an incorrect use of them, or who acquire numerous units of the promotion under different identities.

1 6 . VALUE ADDED TAX AND BILLING

In accordance with the provisions of Law 37/1992, of December 28, on Value Added Tax, and other provisions where applicable, the delivery of the articles will be understood to be located in the territory of application of Spanish VAT if the Delivery address is in Spanish territory except the Canary Islands. The applicable VAT rate will be the one legally in force at all times depending on the specific article in question.

In orders destined for the Canary Islands, deliveries will be exempt from VAT by application of the provisions of Law 37/1992, without prejudice to the application of the corresponding taxes and duties in accordance with the regulations in force in each of these territories. The corresponding DUA of entry of the merchandise in the Canary Islands will be in charge of the client.

You expressly authorize us to issue the invoice in electronic format, although you can indicate to us at any time your desire to receive a paper invoice, in which case, we will issue and send the invoice in said format. You can request it by contacting our customer service, through any of the means made available to you and free of charge.

1 7 . GUARANTEE

1 7 .1 Cosmetic and beauty products (makeup, brushes, shadows, lipsticks, etc…) do not have a return guarantee covered by law due to their nature as consumer goods. Returns will only be accepted if a product arrives in poor condition due to factory problems or transportation problems. Returns will not be accepted for unjustified reasons such as customer dissatisfaction due to unexpected aroma or textures or to the customer’s taste.

Wrong product. If the product delivered does not match the one requested in the order, you must notify us immediately within 24 hours . Contact us by email at orders@ami-iyok.com and we will process your incident as soon as possible.

The company Ami iyök is not responsible for delays in transport arising from the outsourced logistics company, for which it reserves the rights not to accept returns due to delays in transport.

E-commerce returns will only be accepted upon express request due to delays in transport as long as the package has not been tampered with and the box seals are kept intact as the transport company delivered it.

17.2 If you contract as a consumer and user, we offer you complete sanitary, technical and storage guarantees on the products that we commercialize through this website, in the legally established terms for each type of product, taking into account that our products do not exceed the 6 months time in our warehouses.

We inform you that, as a consumer, you have a period of 2 months to inform us of the lack of conformity, counted from the time you became aware of it.

  • Do not use the product for a purpose other than that intended by the manufacturer;
  • Respect the date of minimum durability or the term of use of the product after opening (PAO), indicated in months or years within the PAO symbol;

The main rules of correct and reasonable use of the product are :

  • Wash your hands before use;
  • Follow the instructions for use indicated on the label;
  • Consider the warnings indicated on the labeling and information leaflet where appropriate;

1 7 . 4 . In this sense, if any of the products does not comply with the contract, you must inform us by following the procedure detailed in this section 17 and through any of the means of communication provided for this purpose or in the email requests @ ami- iyok.com

18 . DEFECTIVE PRODUCTS OR NOT COMPLIANT WITH THE CONTRACT

18 .2. You are informed that if the lack of conformity is minor, the contract will not be terminated.

  6. Acts, decrees, legislation, regulations or restrictions of any government or public authority.
  7. Global pandemic similar to SARS COVID19.

No waiver by us of any of these c onditions or rights or actions derived from a contract shall take effect unless expressly stated to be a waiver and is formalized and communicated to you in writing in accordance with paragraph of n previous otifications.

2 6 . PARTIAL NULLITY

If any of these c onditions or any provision of a contract is declared null and void by judgment given by competent authority, the remaining terms and conditions shall remain in force, without being affected by the declaration of nullity.

2 7 . ENTIRE AGREEMENT

These c onditions and any document referenced expressed therein constitute the entire agreement existing between you and us relating to the subject thereof and supersede any prior agreement, arrangement or earlier promise agreed between you and us verbally or in writing.

28 . OUR RIGHT TO MODIFY THESE CONDITIONS
